Pasal 16(1) Iuran Jaminan Kesehatan

Pasal 16
(1) Iuran Jaminan Kesehatan bagi Peserta PBI
Jaminan Kesehatan dibayar oleh Pemerintah.
(1a) Iuran Jaminan Kesehatan bagi penduduk yang
didaftarkan oleh Pemerintah Daerah dibayar oleh
Pemerintah Daerah.
(2) Iuran Jaminan Kesehatan bagi Peserta Pekerja
Penerima Upah dibayar oleh Pemberi Kerja dan
Pekerja.
(3) Iuran Jaminan Kesehatan bagi Peserta Pekerja
Bukan Penerima Upah dan Peserta bukan Pekerja
dibayar oleh Peserta yang bersangkutan.
(3a) Ketentuan sebagaimana dimaksud pada ayat (3)
tidak berlaku bagi:
a. penerima pensiun sebagaimana dimaksud
dalam Pasal 4 ayat (5) huruf a, huruf b, huruf
c, dan huruf d; dan
b. Veteran dan Perintis Kemerdekaan.
(4) Dihapus.
8. Diantara Pasal 16 dan Pasal 17 disisipkan 9
(sembilan) pasal, yakni Pasal 16A, Pasal 16B, Pasal
16C, Pasal 16D, Pasal 16E, Pasal 16F, Pasal 16G,
Pasal 16H, dan Pasal 16I sehingga berbunyi sebagai
berikut:

Pasal 16A
Iuran Jaminan Kesehatan bagi Peserta PBI Jaminan
Kesehatan serta penduduk yang didaftarkan oleh
Pemerintah Daerah sebesar Rp 19.225,00 (sembilan
belas ribu dua ratus dua puluh lima rupiah) per
orang per bulan.
Pasal 16B
(1) Iuran Jaminan Kesehatan bagi Peserta Pekerja
Penerima Upah yang terdiri atas Pegawai Negeri
Sipil, Anggota TNI, Anggota Polri, Pejabat Negara,
dan Pegawai Pemerintah Non Pegawai Negeri
sebesar 5% (lima persen) dari Gaji atau Upah per
bulan.
(2) Iuran sebagaimana dimaksud pada ayat (1)
dibayar dengan ketentuan sebagai berikut:
a. 3% (tiga persen) dibayar oleh Pemberi Kerja;
dan
b. 2% (dua persen) dibayar oleh Peserta.
(3) Kewajiban Pemberi Kerja dalam membayar iuran
sebagaimana dimaksud pada ayat (2) huruf a,
dilaksanakan oleh:
a. Pemerintah untuk Iuran Jaminan Kesehatan
bagi Pegawai Negeri Sipil Pusat, Anggota TNI,
Anggota Polri, Pejabat Negara, dan Pegawai
Pemerintah Non Pegawai Negeri Pusat; dan
b. Pemerintah …

b. Pemerintah Daerah untuk Iuran Jaminan
Kesehatan bagi Pegawai Negeri Sipil Daerah
dan Pegawai Pemerintah Non Pegawai Negeri
Daerah.
Pasal 16C
(1) Iuran Jaminan Kesehatan bagi Peserta Pekerja
Penerima Upah selain Peserta sebagaimana
dimaksud dalam Pasal 16B ayat (1) yang
dibayarkan mulai tanggal 1 Januari 2014 sampai
dengan 30 Juni 2015 sebesar 4,5% (empat koma
lima persen) dari Gaji atau Upah per bulan
dengan ketentuan:
a. 4% (empat persen) dibayar oleh Pemberi Kerja;
dan
b. 0,5% (nol koma lima persen) dibayar oleh
Peserta.
(2) Iuran Jaminan Kesehatan bagi Peserta
sebagaimana dimaksud pada ayat (1) yang
dibayarkan mulai tanggal 1 Juli 2015 sebesar 5%
(lima persen) dari Gaji atau Upah per bulan
dengan ketentuan:
a. 4% (empat persen) dibayar oleh Pemberi Kerja;
dan
b. 1% (satu persen) dibayar oleh Peserta.

(3) Iuran sebagaimana dimaksud pada ayat (1) dan
ayat (2) dibayarkan secara langsung oleh Pemberi
Kerja kepada BPJS Kesehatan.
Pasal 16D
Batas paling tinggi Gaji atau Upah per bulan yang
digunakan sebagai dasar perhitungan besaran Iuran
Jaminan Kesehatan bagi Peserta Pekerja Penerima
Upah sebagaimana dimaksud dalam Pasal 16C dan
pegawai pemerintah non pegawai negeri sebagaimana
dimaksud dalam Pasal 16B ayat (1) sebesar 2 (dua)
kali Penghasilan Tidak Kena Pajak (PTKP) dengan
status kawin dengan 1 (satu) orang anak.
Pasal 16E
(1) Gaji atau Upah yang digunakan sebagai dasar
perhitungan Iuran Jaminan Kesehatan
sebagaimana dimaksud dalam Pasal 16B ayat (1)
terdiri atas Gaji atau Upah pokok dan tunjangan
keluarga, kecuali bagi Pegawai Pemerintah Non
Pegawai Negeri.
(2) Iuran Jaminan Kesehatan untuk Pegawai
Pemerintah Non Pegawai Negeri sebagaimana
dimaksud pada ayat (1) dihitung berdasarkan
penghasilan tetap.

(3) Gaji atau Upah yang digunakan sebagai dasar
perhitungan Iuran Jaminan Kesehatan
sebagaimana dimaksud dalam Pasal 16C terdiri
atas Gaji atau Upah pokok dan tunjangan tetap.
(4) Tunjangan tetap sebagaimana dimaksud pada
ayat (3) merupakan tunjangan yang dibayarkan
kepada Pekerja tanpa memperhitungkan
kehadiran Pekerja.
Pasal 16F
Iuran Jaminan Kesehatan bagi Peserta Pekerja Bukan
Penerima Upah dan Peserta bukan Pekerja:
a. sebesar Rp 25.500,00 (dua puluh lima ribu lima
ratus rupiah) per orang per bulan dengan Manfaat
pelayanan di ruang perawatan Kelas III.
b. sebesar Rp 42.500,00 (empat puluh dua ribu lima
ratus rupiah) per orang per bulan dengan Manfaat
pelayanan di ruang perawatan Kelas II.
c. sebesar Rp 59.500,00 (lima puluh sembilan ribu
lima ratus rupiah) per orang per bulan dengan
Manfaat pelayanan di ruang perawatan Kelas I.
