Sumber hukum dibedakan menjadi dua

Sumber hukum dibedakan menjadi dua yaitu sumber hukum formail dan sumber hukum materiil. Sumber hukum formail adalah sumber hukum yang dilihat dari bentuknya, sedang sumber hukum materiil adalah segala sesuatu yang menentukan isi dari hukum. Menurut Starke, sumber hukum materiil hukum internasional diartikan sebagai bahan-bahan aktual yang digunakan oleh para ahli hukum intrenasional untuk menetapkan hukum yang berlaku bagi suatu peristiwa atau situasi tertentu
