Fenomena PKL dan masalah – masalah yang ditimbulkan PKL seperti yang telah diuraikan di atas, dianggap menyulitkan dan menghambat pemerintah untuk mewujudkan sebuah kota yang bersih dan tertib salah satunya, walaupun pemerintah telah membuat kebijakan Perda untuk melarang keberadaan PKL, faktanya jumlah PKL malah semakin banyak. Dan tentu kebijakan Perda tersebut memenuhi banyak kontra dari para PKL karena kebijakan pemerintah itu dianggap tidak tepat, tidak adil dan merugikan para PKL  Kemudian yang menambah daftar panjang permasalahan PKL ini adalah pendekatan yang dilakukan pemerintah dalam praktiknya banyak menggunakan kekerasan. Pendekatan kekerasan yang akan dilakukan pemerintah justru akan menjadi boomerang bagi pemerintah itu sendiri, sehingga akan timbul ketidakstabilan, anarkisme dan ketidaktentraman yang dampaknya justru akan menurunkan citra pemerintah sebagai pembuat kebijakan , yang paling menarik menurut kami dari adanya permasalahan PKL ini adalah karena PKL menjadi sebuah dilema tersendiri bagi pemerintah. Di satu sisi PKL sering mengganggu tata ruang kota, disisi lain PKL menjalankan peran sebagai Shadow Economiy. Kita juga harus melihat bahwa PKL memiliki beberapa segi positif, salah satunya adalah memberikan kemudahan mendapatkan barang dengan harga terjangkau. Apabila Indonesia ingin bebas dari PKL maka pemerintah harus memberikan lapangan pekerjaan yang layak dan lebih baik kepada para PKL tersebut, dan juga memberikan alternatif tempat membeli barang dengan harga yang murah khususnya pada warga golongan menengah bawah. Apabila masyarakat dipaksakan untuk membeli barang yang harganya lebih tinggi daripada membeli di PKL maka daya beli masyarakat akan berkurang dan akan merembet pada bidang lain terutama kesehatan dan pendidikan. Apabila kita berbicara mengenai kebijakan – kebijakan yang dibuat pemerintah pasti mempunyai alas hak (aturan hukum) atau didasarkan pada asas legalitas, yaitu bahwa pemerintah tunduk pada undang-undang.Kebijakan publik mempunyai arti serangkaian tindakan yang ditetapkan dan dilaksanakan atau tidak dilaksanakan oleh pemerintah yang mempunyai tujuan atau berorientasi pada tujuan tertentu demi kepentingan seluruh masyarakat.Berbicara  mengenai kebijakan pemerintah berarti di sini adalah segala hal yang diputuskan pemerintah. Definisi ini menunjukkan bagaimana pemerintah memiliki otoritas untuk membuat kebijakan yang bersifat mengikat. Dalam proses pembuatan kebijakan terdapat dua model pembuatan, yang bersifat top-down danbottom-up. Idealnya proses pembuatan kebijakan hasil dari dialog antara masyarakat dengan pemerintah. Sehingga kebijakan tidak bersifat satu arah.Kembali pada persolan pertama, bahwa pemerintah dalam hal ini memiliki suatu kebijakan untuk menangani masalah PKL, yaitu suatu kebijakan yang melarang keberadaan PKL dengan dikeluarkannya Perda (Peraturan Daerah). Pemerintah Kota/daerah mengeluarkan kebijakan yang isinya antara lain .1)      Pedagang Kaki Lima dipindah lokasikan ke tempat yang telah disediakan berupa kios-kios.2)      Kios kios tersebut disediakan secara gratis.3)      Setiap kios setiap bulan ditarik retribusi4)      Bagi Pedagang yang tidak pindah dalam jangka waktu 90 hari setelah keputusan ini dikeluarkan akan dikenakan sangsi sesuai dengan peraturan yang berlaku.Dengan demikian, Pemerintah kota menganggap kebijakan relokasi tersebut merupakan tindakan yang terbaik bagi PKL dan memudahkan PKL. Karena dengan adanya kios – kios yang disediakan pemerintah, pedagang tidak perlu membongkar muat dagangannya. Selain itu, pemerintah juga berjanji akan memperhatikan aspek promosi, pemasaran, bimbingan pelatihan, dan kemudahan modal usaha. Pemerintah merasa telah melakukan hal yang terbaik dan bijaksana dalam menangani keberadaan PKL.
