Pasal 5(1) Anggota keluarga sebagai

Pasal 5
(1) Anggota keluarga sebagaimana dimaksud dalam
Pasal 4 ayat (1) huruf a meliputi istri/suami yang
sah, anak kandung, anak tiri dari perkawinan
yang sah, dan anak angkat yang sah, sebanyakbanyaknya
5 (lima) orang.

(2) Anak kandung, anak tiri dari perkawinan yang
sah, dan anak angkat yang sah sebagaimana
dimaksud pada ayat (1), dengan kriteria:
1. tidak atau belum pernah menikah atau tidak
mempunyai penghasilan sendiri; dan
2. belum berusia 21 (dua puluh satu) tahun atau
belum berusia 25 (dua puluh lima) tahun yang
masih melanjutkan pendidikan formal.
(3) Peserta bukan PBI Jaminan Kesehatan dapat
mengikutsertakan anggota keluarga yang lain.
(4) Anggota keluarga yang lain sebagaimana
dimaksud pada ayat (3) meliputi anak ke 4
(empat) dan seterusnya, ayah, ibu, dan mertua.
4. Ketentuan Pasal 6 diubah sehingga berbunyi sebagai
berikut:
Pasal 6
(1) Kepesertaan Jaminan Kesehatan bersifat wajib
dan mencakup seluruh penduduk Indonesia.
(2) Kepesertaan Jaminan Kesehatan sebagaimana
dimaksud pada ayat (1) mulai tanggal 1 Januari
2014 paling sedikit meliputi:
a. PBI Jaminan Kesehatan;
b. Anggota TNI/Pegawai Negeri Sipil di
lingkungan Kementerian Pertahanan dan
anggota keluarganya;
c. Anggota …

c. Anggota Polri/Pegawai Negeri Sipil di
lingkungan Polri dan anggota keluarganya;
d. Peserta asuransi kesehatan Perusahaan
Persero (Persero) Asuransi Kesehatan
Indonesia (ASKES) dan anggota keluarganya;
dan
e. Peserta Jaminan Pemeliharaan Kesehatan
Perusahaan Persero (Persero) Jaminan Sosial
Tenaga Kerja (JAMSOSTEK) dan anggota
keluarganya.
(3) Kewajiban melakukan pendaftaran kepesertaan
Jaminan Kesehatan selain Peserta sebagaimana
dimaksud pada ayat (2), bagi:
a. Pemberi Kerja pada Badan Usaha Milik Negara,
usaha besar, usaha menengah, dan usaha
kecil paling lambat tanggal 1 Januari 2015;
b. Pemberi Kerja pada usaha mikro paling lambat
tanggal 1 Januari 2016; dan
c. Pekerja bukan penerima upah dan bukan
Pekerja paling lambat tanggal 1 Januari 2019.
(4) BPJS Kesehatan mulai tanggal 1 Januari 2014
tetap berkewajiban menerima pendaftaran
kepesertaan yang diajukan oleh Pemberi Kerja
serta Pekerja Bukan Penerima Upah dan bukan
Pekerja sebagaimana dimaksud pada ayat (3).

5. Diantara Pasal 6 dan Pasal 7 disisipkan 1 (satu)
pasal, yakni Pasal 6A sehingga berbunyi sebagai
berikut:
Pasal 6A
Penduduk yang belum termasuk sebagai Peserta
Jaminan Kesehatan dapat diikutsertakan dalam
program Jaminan Kesehatan pada BPJS Kesehatan
oleh pemerintah daerah provinsi atau pemerintah
daerah kabupaten/kota.
6. Ketentuan Pasal 11 ayat (1) diubah, diantara ayat (2)
dan ayat (3) disisipkan 2 (dua) ayat, yakni ayat (2a)
dan ayat (2b), sehingga Pasal 11 berbunyi sebagai
berikut:

(1) Pemberi Kerja sesuai ketentuan Pasal 6 ayat (3)
dan ayat (4) wajib mendaftarkan dirinya dan
Pekerjanya sebagai Peserta Jaminan Kesehatan
kepada BPJS Kesehatan dengan membayar iuran.
(2) Dalam hal Pemberi Kerja secara nyata-nyata tidak
mendaftarkan Pekerjanya kepada BPJS
Kesehatan, Pekerja yang bersangkutan berhak
mendaftarkan dirinya sebagai Peserta Jaminan
Kesehatan.

(2a) Pekerja yang mendaftarkan dirinya sebagai
Peserta Jaminan Kesehatan sebagaimana
dimaksud pada ayat (2), iurannya dibayar sesuai
ketentuan Peraturan Presiden ini.
(2b) Dalam hal Pekerja belum terdaftar pada BPJS
Kesehatan, Pemberi Kerja wajib bertanggung
jawab pada saat Pekerjanya membutuhkan
pelayanan kesehatan sesuai dengan Manfaat yang
diberikan oleh BPJS Kesehatan.
(3) Setiap Pekerja Bukan Penerima Upah wajib
mendaftarkan dirinya dan anggota keluarganya
secara sendiri-sendiri atau berkelompok sebagai
Peserta Jaminan Kesehatan pada BPJS Kesehatan
dengan membayar iuran.
(4) Setiap orang bukan Pekerja wajib mendaftarkan
dirinya dan anggota keluarganya sebagai Peserta
Jaminan Kesehatan kepada BPJS Kesehatan
dengan membayar iuran.
7. Di antara ayat (1) dan ayat (2) Pasal 16 disisipkan 1
(satu) ayat, yakni ayat (1a), di antara ayat (3) dan ayat
(4) Pasal 16 disisipkan 1 (satu) ayat, yakni ayat (3a),
ketentuan ayat (4) dihapus, sehingga Pasal 16
