sejarah pengaturan HAM yang bersifat internasional harus dihasilkan tepatnya setelah majelis Umum PBB mengesahkan Deklarasi Universal HAM (DUHAM) pada tanggal 10 Deseber 1948 . Deklarasi ini merupakan dokumen Internasional pertama yang didalamnya berisikan katalog HAM yang dibuat berdasarkan suatu kesepakatan internasional kemudian , pada tahun 1966 dihasilkan perjanjan international (treaty) yang di dalamnya terdapat mekanisme pengawasan dan perlindungan HAM , yaitu Kovenan International tentang Hak-hak sipil dan politik (international covenant on civil and political rights / ICCPR ) serta Hak-hak , Ekonomi , social dan budaya ( International Covenant on Economic , social , and Cultural Rights/IESCR ) . Ketiganya dikenal dengan istilah “the International Bill of Human Rights”.
