A. Konstitusi Yang Penah Berlaku di Indonesia

1. Pengertian dan Pentingnya Konstitusi

Konstitusi merupakan jaminan yg paling efektif dalam menjaga agar kekuasaan yg ada dlm Negara tidak salah gunakan dan hak asasi manusia/warga Negara tidak dilanggar,konstitusi sangat penting artinya bagi suatu Negara karena kedudukannya dalam mengatur dan membatasi kekuasan dalam suatu Negara.

Konstitusi berasal dari istilah bahasa Prancis,yaitu constituer artinya membentuk.beberapa istilah dari konstitusi seperti gronwet ( bahasa Belanda ) artinya,yaitu wet berarti undang-undang dan ground berarti tanah.Beberapa Negara yg menggunakan istilah constitution ( bahasa Inggris ) untuk mengartikan konstitusi.

Dalam bahasa Indonesia ,kontitusi diartikan sebagai hukum dasar atau undang-undang dasar.Istilah itu menggambarkan keseluruhan system ketatanegaraan suatu Negara.

Beberapa ahli kertanegaraan yg menyatakan tentang pengertian konstitusi yaitu :

a. Herman Heller

Kontitusi dibagi menjadi tiga :

1. Kontitusi yg mencerminkan kehidupan politik di dalam masyarakat sebagai suatu kenyataan. Disebut pengertian secara sosiologis.

2. Konstitusi merupakan satu kesatuan kaidah yg hidup dalam masyarakat merupakan pengertian secara yuridis.

3. Konstitusi yg ditulis dalam suatu naskah sebagai undang-undang yg tinggi dan berlaku dalam suatu Negara.disebut pengertian secara politis.

b. K.C. Wheare

Kontitusi adalah keseluruhan system ketatanegaraan dari suatu Negara berupa kumpulan peraturan yg membentuk,mengatur/memerintah dalam suatu Negara. Pengertian konstitusi secara sempit adalah keseluruhan peraturan Negara yg bersifat tertulis.

Pengertian konstitusi secara luas adalah keseluruhan peraturan Negara,baik yg tartulis maupun tidak tertulis sering disebut konvensi Konstitusi sebagai hukum dasar yg memiliki arti penting bagi Negara.

Budiarjo menyatakan bahwa konstitusi /undang-undang dasar ketentuan sebagai berikut.

• Pembagian kekuasaan antara lembaga eksekutif,legislative dan yudikatif • Hak asasi manusia

• Prosedur perubahan UUD

• Larangan untuk mengubah sifat tertentu dari UUD Pembatasan kekuasaan untuk mencakup dua hal, yaitu isi kekuasaan dan waktu pelaksanaan pembatasan isi kekuasaan mengandung arti bahwa dalam konstitusi ditentukan tugas serta wewenang lembaga-lembaga Negara.

Konstitusi dinegara kita adlah UUD 1945.UUD 1945 ialah hukum dasar yg tertulis Sebagai hukum dasar,UUD 1945 merupakan sumber hukum.Jadi,semua perundang undangan dan peraturan –peraturan harus bersumber pada UUd 1945

2. Berbagai konstitusi yg Pernah Berlaku di Indonesia

a. UUD 1945 ( 18 Agustus 1945-27 Desember 1949 ) semua Negara perlu memiliki UUD/ konstitusi . Indonesia sebagai suatu Negara juga memiliki UUD yg kita sebut UUD 1945. Untuk lebih jelas mempelajari UUD 1945, akan diuraikan sebagai berikut :

1) Persiapan Pembentukan UUD 1945

2) Pengesahan UUD 1945

3) Sistematika UUD 1945

b. Konstitusi RIS 27 Desember 1949-17 Agustus 1950

Pada tanggal 23 Agustus 1949-2 September 1949 , dikota denhaag (Belanda) diadakan Konferensi Meja Bundar (KMB) .

Dgn bentuk Negara federasi, RIS meliputi beberapa daerah Indonesia seperti dinyatakan dalam pasal 2 konstitusi RIS 1949

B. UUDS 1950 (17 Agustus 1950-5 Juli 1959)

Republik Indonesia Serikat terdiri atas 16 negara bagian.

RIS yg berdiri sejak tanggal 27 Desember 1949 hanya berlaku kurang dari satu tahun. UUDS 1950 terdiri atas beberapa bagian –bagian ,yaitu sebagai berikut.

1. Mukadimah yg terdiri atas empat alinea ,terdapat rumusan pancasila sebagai dasar Negara.

2. Batang tubuh yg terdiri atas 6 Bab 147

C. UUD 1945 (5 Juli 1959-11 Maret 1966)

UUD 1950 adalah UUD sementara yg berlaku sampai konstituante dpt menyusun dan menetap kan UUD. Pada tahun 1955, pemilihan umum di laksanakan.

D. UUD 1945 setelah Amandemen (19 Oktober 1999-sekarang )

MPR RI telah melakukan perubahan UUD 1945 sebagai salah satu tuntutan reformasi.

UUD 1945 setelah di Amandemen. Jadi, konstitusi yang pernah berlaku di Negara Kesatuan Republik Indonesia adalah UUD 1945, Konstitusi RIS, UUDS 1950, UUD 1945 hasil Amandemen.
