1.1.1 Pengelolaan Desa
Berdasarkan Peraturan Mentri Dalam Negeri Republik Indonesia Nomor 113 Tahun 2014 Tentang Pengelolaan Keuangan Desa pada :
a. Pasal 9 ayat 1 menyatakan bahwa pendapatan desa terdiri dari pendapatan asli desa (Padesa), Transfer dan Pendapatan lain-lain.
b. Pasal 10 ayat 4 menyatakan kelompok pendapatan lain-lain terdiri dari Hibah dan sumbangan pihak ketiga yang tidak mengikat dan lain-lain pendapatan desa yang sah
c. Pasal 31 menyatakan bahwa Bendahara Desa sebagai wajib pungut pajak penghasilan (Pph) dan pajak lainnya, wajib menyetorkan seluruh penerimaan potongan dan pajak yang dipungutnya ke rekening kas Negara sesuai dengan ketentuan peraturan perundang-undang
d. Pasal 32 menyatakan pengadaan barang dan/atau jasa di desa diatur dengan peraturan Bupati /walikota dengan berpedoman dengan ketentuan peraturan perundangan
e. Pasal 44 ayat 1 menyatakan pemerintah provisi wajib membina dan mengawasi pemberian dan penyaluran Dana Desa , alokasi desa

Berdasarkan Peraturan Menteri Desa, Pembangunan Daerah Tertinggal dan Transmigrasi Indonesia Nomor 1 Tahun 2015 Tentang Pedoman Kewenangan Berdasarkan Hak Asal Usul dan Kewenangan Lokal Berskala Desa pada :
a. Pasal 2 butir f menyatakan ruang lingkup kewenangan antara lain pengelolaan tanah desa atau tanah hak milik desa yang menggunakan setempat
b. Pasal 7 menyatakan kewenangan lokal berskala desa meliputi bidang pemerintahan, pembangunan desa, kemasyarakatan desa dan pemberdayaan masyarakat desa
c. Pasal 8 butir l menyatakan bahwa kewenangan lokasi berskala desa di bidang pemerintahan desa meliputi penetapan BUM Desa
d. Pasal 11 butir e menyatakan kewenangan lokal berskala desa di bidang sarana dan prasarana meliputi pembangunan energy baru dan tarbarukan
e. Pasal 15 menyatakan bupati/walikota melakukan pengkajian untuk identifikasi dan inventarisasi kewenangan desa

Berdasarkan Peraturan Menteri Desa, Pembangunan Daerah Tertinggal dan Transmigrasi Indonesia Nomor 4 Tahun 2015 Tentang Pendirian, Pengurusan dan Pengelolaan dan Pembubaran Badan Usaha Milik Desa pada ;
a. Pasal 5 ayat 1 menyatakan bahwa pendirian BUM Desa disepakati melalui musyawarah desa, sebagaimana diatur dalam peraturan Menteri Desa, Pembangunan Daerah Tertinggal dan Transmigrasi Tentang Pedoman Tata Tertib dan Mekanisme Pengambilan Keputusan Musyawarah Desa
b. Pasal 8 menyatakan bahwa BUM Desa dapat membentuk unit usaha meliputi Perseroan Terbatas sebagai persekutuan modal , dibentuk berdasarkan pernjanjian dan melakukan kegiatan usaha dengan modal yang sebagian besar dimiliki oleh BUM Desa sesuai dengan undang-undang perseroan terbatas dan dapat juga berbentuk Lembaga Keuangan Mikro dengan andil BUM Desa 60% sesuai dengan peraturan perundang-undangan tentang lembaga keuangan mikro.
