ABSTRAK

Penelitian skripsi ini membahas bagaimana pengaturan tindak pidana perdagangan orang (Human Traffficking) dalam hukum positif Indonesia serta ditinjau dari perspektif hak asasi manusia (HAM) apabila di lihat didalam Kitab Undang-Undang Hukum Pidana (KUHP), Konvensi Internasional (Perjanjian Internasional dan DUHAM) serta Perundang- undangan lainnya yang berkaitan.
Penelitian ini menggunakan metode Yuridis-Normatif dengan pendekatan Deskriptif Analistis.
Dari hasil penelitian ini dapat disimpulkan bahwa sebelum adanya Undang- Undang Nomor 21 Tahun 2007 tentang Tindak Pidana Perdagangan Orang, Indonesia telah mempunyai beberapa pedoman perundang- undangan. Antara lain: Sila ke-2 Pancasila, Pasal 297 dan Pasal 324 KUHP, serta Pasal 83 Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak.
Dalam hal ini juga, Pemerintah Indonesia wajib memberikan perlindungan hukum agar terjamin hak asasi setiap warga negaranya yang bekerja di dalam dan di luar negeri. Mulai hak untuk hidup, hak untuk memperoleh pendidikan serta hak menentukan jalan hidupnya sendiri dan lain- lain.
Maka Dunia Internasional pun, hal ini Perserikatan Bangsa- Bangsa (PBB) telah memberikan perhatian serius mengenai kejahatan kemanusian ini (Human Trafficking) karena dianggap sebagai kejahatan kemanusiaan dan pelanggaran HAM berat. Dan supaya dapat mendorong serta intensif pengawasan melalui sektor lintas negara anggota PBB untuk selalu memberikan perlindungan hukum dan pelayanan yang optimal terhadap para korban kejahatan perdagangan orang.

JURIDICAL REVIEW "CRIMINAL ACTS OF TRAFFICKING IN PERSONS (HUMAN TRAFFICKING) IN THE PERSPECTIVE OF HUMAN RIGHTS ".ABSTRACTThis thesis discusses how research setting criminal acts of trafficking in persons (Human Traffficking) in Indonesia as well as positive law is reviewed from the perspective of human rights (human rights) when seen in the book of the law of criminal law (CRIMINAL CODE), international conventions (international treaties and DUHAM) as well as other invitation-Militate related issues.This research uses the Juridical-Normative method with Descriptive approach Analistis.From the results of this research it can be concluded that prior to Act No. 21 of 2007 about the criminal acts of trafficking in persons, Indonesia does have some guideline militate-invitation. IN PERSPECTIVE OF HUMAN RIGHTS ". ABSTRACT This paper discusses research on how the crime of trafficking in persons (Human Traffficking) in Indonesian positive law as well as viewed from the perspective of human rights (HAM) if in view in the Code of Criminal Law (Criminal Code), the International Convention (International Treaties and UDHR) and other relevant Legislation. This study uses a juridical-Normative Descriptive Analytical approach.
