Dari hasil penelitian ini dapat diperoleh gambaran bahwa kedudukan Rapat Umum Pemegang Saham Luar Biasa (RUPS-LB) terhadap pemblokiran pendaftaran Perseroan Terbatas berdasarkan Undang-undang Nomor 40 tahun 2007 tentang Perseroan Terbatas yang telah secara mengatakan bahwa setiap orang berhak atas pengakuan jaminan perlindungan, dan kepastian hukum yang adil serta perlakuan yang sama dihadapan hukum, sehingga dengan demikian pasal 86 ayat (9) Undang-undang Nomor 40 tahun 2007 tentang perseroan terbatas haruslah dinyatakan Inkonstitusional. Sehinggga kepastian hukum RUPS-LB PT. Metromini adalah dapat didaftarkan kembali pendaftaran RUPS untuk penggantian pengurus dan anggaran dasar serta upaya hukum yang dilakukan untuk mendapatkan kepastian hukum di dalam RUPS dengan dengan mengajukan uji materi UUPT ke Mahkamah Konstitusi yang bersifat final dan mengikat dan dapat melakukan upaya hukum berupa gugatan ke Peradilan Tata Usaha Negara apabila penolakan yang dilakukan oleh Direktorat Jenderal Administrasi Hukum Umum, hal ini diatur dalam pasal 3 ayat (1) UU Nomor 5 tahun 1986 tentang PTUN.
