Yang dimaksud dengan Keadaan Kahar

Yang dimaksud dengan Keadaan Kahar dalam Perjanjian adalah terjadinya hal-hal yang terbukti di luar kemampuan yang wajar dari salah satu PIHAK dan/atau PARA PIHAK untuk mengatasinya dan bukan disebabkan karena kesalahan atau kesengajaan salah satu PIHAK atau PARA PIHAK yang mengakibatkan tidak terlaksananya Perjanjian baik seluruhnya maupun sebagian. Keadaan Kahar harus dapat dibuktikan dan termasuk tetapi tidak terbatas pada: kerusuhan, huru hara, pemberontakan, pemogokan nasional, peperangan, embargo, blokade, petir, topan/badai, banjir, kebakaran, gempa bumi, bencana alam, wabah penyakit, bencana asap atau kejadian lain yang disepakati PARA PIHAK;

Is the State of Kahar in the agreement is the occurrence of things that proved beyond reasonable ability of one of the parties and/or the PARTIES to resolve it and not because of mistake or deliberate action of either party or the parties in the implementation of the Agreements not resulting in whole or in part. The circumstances must be proved and Kahar include but are not limited to: riot, riot, rebellion, strikes, war, embargo, blockade, lightning, Typhoon/hurricane, floods, fires, earthquakes, natural disasters, disease outbreaks, disasters or other incidents of smoke which was agreed upon by the PARTIES;

What is meant by a Force Majeure in the Treaty are the things that proved beyond the capabilities reasonable than one PARTY and / or THE PARTIES to overcome it and not caused by a mistake or a deliberate one PARTY or PARTIES which resulted in the implementation of the Agreement, either in whole or in part. Force Majeure shall be proved, and include but are not limited to: riot, riot, insurrection, national strikes, wars, embargoes, blockades, lightning, hurricanes / typhoons, floods, fires, earthquakes, natural disasters, epidemics, disasters smoke or another incident agreed OF tHE PARTIES;
