MENYIKAPI PANDANGAN PROF. MUSDAH MULIA TENTANG PERKAWINAN SEJENIS DI INDONESIA.
Bagaimana sebaiknya seorang beragama menyikapi berbagai perbedaan keyakinan di negara indonesia yang memiliki berbagai macam kepercayaan dan agama?
Bermula dari pandangan Prof. Musdah Mulia, guru besar dan dosen pasca sarjana Universitas Islam negeri, Jakarta, sejak ‘insident’ beberapa tahun lalu pada seminar perempuan tingkat nasional bertema “Adilkah Bangsa dan Agama Terhadapmu” di Gedung Mulo, Jl Sungai Saddang, Makassar, Senin (30/5/2011) dan beberapa tulisan pada buku yang diberi judul Counter Legal Draft (CLD) Kompilasi Hukum Islam (KHI). maupun makalah yang mengharamkan poligami, memberi masa iddah bagi laki-laki, menghilangkan peran wali nikah bagi mempelai wanita, menghalalkan perkawinan sejenis, menuai 'kontroversial'.
Melandasi konsep pemikirannya, menurut Musdah Mulia, intisari ajaran Islam adalah memanusiakan manusia dan menghormati kedaulatannya. Mengutip QS 49 ayat 3, Musdah menyatakan, salah satu berkah Tuhan adalah bahwasanya semua manusia, baik laki-laki atau wanita, adalah sederajat, tanpa memandang etnis, kekayaan, posisi social atau pun orientasi seksual. Karena itu, aktivis liberal dan kebebasan beragama dari ICRP (Indonesia Conference of Religions and Peace) ini, Lebih jauh ia katakan, bahwa homoseksualitas adalah berasal dari Tuhan, dan karena itu harus diakui sebagai hal yang alamiah. “Tidak ada perbedaan antara lesbian dengan non-lesbian. Demikian pendapat guru besar UIN Jakarta ini pada diskusi yang diselenggarakan suatu organisasi bernama “Arus Pelangi”, di Jakarta.
“Menurut prof. Musdah Mulia, yang dilarang dalam teks-teks suci tersebut lebih tertuju kepada perilaku seksualnya, bukan pada orientasi seksualnya. Mengapa? sebab, menjadi heteroseksual, homoseksual (gay dan lesbi), dan biseksual adalah kodrati, sesuatu yang given atau dalam bahasa fikih disebut sunnatullah. Sementara perilaku seksual bersifat kontruksi manusia. Jika hubungan sejenis atau homo, baik gay atau lesbi sungguh-sungguh menjamin kepada pencapaian-pencapaian tujuan dasar tadi maka hubungan demikian dapat diterima. Pandangan ini sebagai kajian ilmu pengetahuan adalah masuk akal karena konsep demikian terbentuk dari metodologi logika keilmuan sebagai orasi dalam ranah budaya. Masih bisa dipahami. Dapat dikatakan demikian karena kebudayaan merupakan hasil rekadaya “cipta, rasa, dan kehendak” manusia dalam memenuhi kebutuhan hidupnya yang dapat bersifat up to date.
Tetapi, manakala melebar mengkritisinya masuki dalam ranah hukum agama tentu akan menuai “badai”. Umat beragama Islam berpandangan berdasarkan Qur’an dan Hadist, bahwa agama Islam adalah “rahmatan lil Alamin” , benar adanya. Namun dalam konteks peribadatan -Habblur minullah, hukumnya sudah tidak bisa diutik-utik lagi dimaknai lain dengan menggunakan ‘logik’ sebagaimana dalam kebudayaan manusia.
Kalangan umat beragama bersikukuh bahwa teks suci tidak bisa dimaknai berlandaskan perkembangan kebudayaan. Teks suci keberadaanya berasal dari Wahyu Illahi yang dijaga kesamaan penafsirannya dari sejak diturunkannya hingga kini. Karena itu, para mufassir al-Quran selama ratusan tahun tidak ada yang berpendapat seperti Prof. Musdah Mulia yang berani menghalalkan homoseksual.
Pandangan Prof. Musdah harus kita hargai sebagai pandangan kebudayaan yang mengajak umat beragama untuk bersikap toleransi kepada sesama umat. Ini sudah benar. Tetapi, manakala memberikan pengesyahan sebuah perkawinan sejenis dengan mengurai dalil teks suci, bisa jadi pandangannya telah tergelincir masuk dalam ‘kubangan’ golongan orang yang ingkar. Amir Syarifuddin, pengurus MUI, menyatakan bahwa praktik homoseksual adalah dosa. “Kami tidak akan menganggap homoseksualitas sebagai musuh, tetapi kami akan membuat mereka sadar bahwa apa yang mereka lakukan adalah salah,” kata Amir Syarifudin.
