Secara internasional, HAM termasuk kedalam sistem hukum internasional (dibentuk oleh masyarakat internasional yang terdiri dari negara-negara). Negara mempunyai peranan penting dalam membentuk sistem hukum tersebut melalui kebiasaan, perjanjian internasional, atau bentuk lainnya seperti deklarasi maupun petunjuk teknis. Kemudian negara menyatakan persetujuannya dan terikat pada hukum internasional tersebut. Dalam HAM, yang dilindungi dapat berupa individu, kelompok atau harta benda. Standar HAM Internasional dibentuk dan dikembangkan dalam berbagai forum internasional. Dalam sistem PBB, setiap perwakilan dari anggota PBB diundang untuk melakukan persiapan dan negosiasi terkait dengan pembentukan standar HAM internasional.
