keluarganya secara lengkap dan benar
kepada BPJS.
(4) Pengawasan dan pemeriksaan sebagaimana
dimaksud pada ayat (1) dapat dilakukan oleh
BPJS berdasarkan pengaduan dari masyarakat
dan pekerja.
(5) BPJS dalam melaksanakan pengawasan dan
pemeriksaan atas kepatuhan Pemberi Kerja Selain
Penyelenggara Negara dalam memenuhi
kewajibannya membayar iuran atau memenuhi
kewajiban lain wajib melaporkan ketidakpatuhan
Pemberi Kerja Selain Penyelenggara Negara
kepada instansi yang bertanggungjawab di bidang
ketenagakerjaan sesuai dengan ketentuan
peraturan perundang-undangan.
(6) Instansi yang bertanggungjawab di bidang
ketenagakerjaan berdasarkan laporan
sebagaimana dimaksud pada ayat (5) melakukan
pemeriksaan terhadap Pemberi Kerja Selain
Penyelenggara Negara yang pelaksanaannya
dilakukan sesuai dengan ketentuan peraturan
perundang-undangan.
(7) Selain berdasarkan laporan sebagaimana
dimaksud pada ayat (6), instansi yang
bertanggungjawab di bidang ketenagakerjaan juga
dapat melakukan pemeriksaan terhadap Pemberi
Kerja yang pelaksanaannya dilakukan sesuai
dengan ketentuan peraturan perundangundangan.

Pasal 14
(1) Dalam melaksanakan pengawasan dan
pemeriksaan atas kepatuhan dalam
penyelenggaraan program jaminan sosial, BPJS
mengangkat petugas pemeriksa.
(2) Ketentuan lebih lanjut mengenai tata cara dan
mekanisme kerja pengawasan dan pemeriksaan
sebagaimana dimaksud pada ayat (1) diatur
dengan Peraturan BPJS.
Pasal 15
Pengawasan terhadap kepatuhan Pemerintah,
pemerintah daerah provinsi, dan pemerintah daerah
kabupaten/kota dalam memberikan sanksi tidak
mendapat pelayanan publik tertentu kepada Pemberi
Kerja Selain Penyelenggara Negara dan setiap orang,
selain pemberi kerja, Pekerja, dan penerima bantuan
iuran dilakukan sesuai dengan ketentuan peraturan
perundang-undangan.
BAB III
KETENTUAN PENUTUP
Pasal 16
Peraturan Pemerintah ini berlaku pada tanggal
diundangkan.

DALAM PENYELENGGARAAN JAMINAN SOSIAL
I. UMUM
Dalam pembukaan Undang-Undang Dasar Negara Republik
Indonesia Tahun 1945 diamanatkan bahwa tujuan negara adalah
untuk meningkatkan kesejahteraan rakyat. Dalam Perubahan Keempat
Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, tujuan
tersebut semakin dipertegas yaitu dengan mengembangkan sistem
jaminan sosial bagi kesejahteraan seluruh rakyat.
Undang-Undang Nomor 24 Tahun 2011 tentang Badan
Penyelenggara Jaminan Sosial menetapkan 2 (dua) Badan
Penyelenggara Jaminan Sosial yaitu BPJS Kesehatan dan BPJS
Ketenagakerjaan untuk melaksanakan program jaminan sosial
nasional. BPJS Kesehatan melaksanakan program jaminan kesehatan
sedangkan BPJS Ketenagakerjaan melaksanakan program jaminan
kecelakaan kerja, jaminan hari tua, jaminan pensiun, dan jaminan
kematian bagi seluruh pemberi kerja, pekerja penerima upah dan
bukan penerima upah beserta anggota keluarganya.
Terlaksananya 5 (lima) program jaminan sosial dalam sistem
jaminan sosial nasional diharapkan dapat menjangkau kepesertaan
secara luas dan berkesinambungan sehingga seluruh penduduk dapat
terpenuhi kebutuhan dasar hidupnya yang layak.
