Sebagaimana telah disebutkan pada halaman sebelumnya, mengenai ruang lingkup dari hukum humaniter, maka dapat diketahui bahwasannya hukum humaniter tersebut terdiri dari Hukum Den Haag dan Hukum Jenewa. Hukum Den Haag mengatur mengenai tata cara serta perlengkapan yang boleh dipakai pada saat berperang, sedangkan Hukum Jenewa mengatur mengenai bentuk-bentuk perlindungan terhadap korban perang. Dengan kata lain, kedua hukum inilah yang menjadi sumber utama dari hukum humaniter.
