Perjanjian secara tertulis akan mempunyai kepastian hukum yang melindungi para pihak dari perbuatan sewenang-wenang salah satu pihak. Selain itu kemudahan dalam proses kredit merupakan bentuk lain dari perlindungan terhadap debitur.
Penelitian tentang ”Perlindungan Hukum Terhadap Debitur Dalam Pelaksanaan Perjanjian Simpan Pinjam di Koperasi Simpan Pinjam Utama Karya Weleri”, bertujuan untuk mengetahui pelaksanaan perjanjian simpan pinjam di Koperasi Simpan Pinjam Utama Karya Weleri. dan perlindungan hukum terhadap debitur dalam perjanjian simpan pinjam di Koperasi Simpan Pinjam Utama Karya Weleri. Metode pendekatan yang digunakan yaitu yuridis sosiologis. Pengumpulan data dilakukan melalui observasi, wawancara, dan studi pustaka dan analisis secara kualitatif.
Pelaksanaan Perjanjian Simpan Pinjam di Koperasi Simpan Pinjam Utama Karya Weleri dilakukan terhadap kegiatan layanan peminjaman dana. Perjanjian penyimpanan dana dalam bentuk tabungan dilakukan melalui tahap tahap permohonan, tahap pendaftaran, tahap penerbitan buku tabungan, tahap pelaksanaan simpanan dana dan tahap tahap penarikan dana tabungan. Sedangkan perjanjian peminjaman dana kredit dilaksanakan melalui tahap tahap permohonan kredit, tahap Analisa Kelayakan Permohonan Kredit, tahap Persetujuan Kredit, dan tahap pencairan dana. Perlindungan hukum Terhadap Debitur dalam Perjanjian Simpan Pinjam di Koperasi Simpan Pinjam Utama Karya Weleri dilakukukan dengan asas kebebasan berkontrak dan perlindungan jaminan kredit jika debitur wanprestasi yaitu penjualan barang jaminan untuk pelunasan hutang sedangkan sisa dari penjualan setelah dikurangi pelunasan hutang dikembalikan kepada debitur.
Agar debitur selalu disiplin dalam melakukan pembayaran angsuran kredit untuk menghindari penjualan barang agunan karena wanprestasi. Agar pihak Koperasi Simpan Pinjam Utama Karya Weleri lebih memberikan kelonggaran terhadap debitur wanprestasi dengan memberikan kesempatan perpanjangan waktu dalam pembayaran pelunasan hutang.
