yang bertanggung jawab kepada Presiden.

2. Ketentuan Pasal 4 ayat (4) dan ayat (5) diubah
sehingga Pasal 4 berbunyi sebagai berikut:
Pasal 4
(1) Peserta bukan PBI Jaminan Kesehatan
sebagaimana dimaksud dalam Pasal 2 huruf b
merupakan Peserta yang tidak tergolong fakir
miskin dan orang tidak mampu yang terdiri atas:
a. Pekerja Penerima Upah dan anggota
keluarganya;
b. Pekerja Bukan Penerima Upah dan anggota
keluarganya; dan
c. bukan Pekerja dan anggota keluarganya.
(2) Pekerja Penerima Upah sebagaimana dimaksud
pada ayat (1) huruf a terdiri atas:
a. Pegawai Negeri Sipil;
b. Anggota TNI;
c. Anggota Polri;
d. Pejabat Negara;
e. Pegawai Pemerintah non Pegawai Negeri;
f. pegawai swasta; dan
g. Pekerja yang tidak termasuk huruf a sampai
dengan huruf f yang menerima Upah.
(3) Pekerja Bukan Penerima Upah sebagaimana
dimaksud pada ayat (1) huruf b terdiri atas:
a. Pekerja …

a. Pekerja di luar hubungan kerja atau Pekerja
mandiri; dan
b. Pekerja yang tidak termasuk huruf a yang
bukan penerima Upah.
(4) Bukan Pekerja sebagaimana dimaksud pada ayat
(1) huruf c terdiri atas:
a. investor;
b. Pemberi Kerja;
c. penerima pensiun;
d. Veteran;
e. Perintis Kemerdekaan;
f. janda, duda, atau anak yatim piatu dari
Veteran atau Perintis Kemerdekaan; dan
g. bukan Pekerja yang tidak termasuk huruf a
sampai dengan huruf e yang mampu
membayar iuran.
(5) Penerima pensiun sebagaimana dimaksud pada
ayat (4) huruf c terdiri atas:
a. Pegawai Negeri Sipil yang berhenti dengan hak
pensiun;
b. Anggota TNI dan Anggota Polri yang berhenti
dengan hak pensiun;
c. Pejabat Negara yang berhenti dengan hak
pensiun;

d. janda, duda, atau anak yatim piatu dari
penerima pensiun sebagaimana dimaksud
pada huruf a, huruf b, dan huruf c yang
mendapat hak pensiun;
e. penerima pensiun selain huruf a, huruf b, dan
huruf c; dan
f. janda, duda, atau anak yatim piatu dari
penerima pensiun sebagaimana dimaksud
pada huruf e yang mendapat hak pensiun.
(6) Pekerja sebagaimana dimaksud pada ayat (1)
huruf a dan huruf b termasuk warga negara asing
yang bekerja di Indonesia paling singkat 6 (enam)
bulan.
(7) Jaminan Kesehatan bagi Pekerja warga negara
Indonesia yang bekerja di luar negeri diatur
dengan ketentuan peraturan perundangundangan
tersendiri.
3. Ketentuan Pasal 5 diubah sehingga berbunyi sebagai
berikut:
