Perjanjian ini tidak dapat dibatalk

Perjanjian ini tidak dapat dibatalkan oleh salah satu pihak, kecuali karena alas an yang secara tegas disebutkan dalam perjanjian ini.
12.2 Apabila terjadi pembatalan Perjanjian ini, maka seluruh jumlah uang yang telah dibayarkan PEMBELI kepada PENJUAL tidak dapat dikembalikan.
12.3 Apabila PEMBELI membatalkan perjanjian ini karena alasan dalam Pasal 3 Ayat 3.4 (b), yang dibuktikan dengan surat pemberitahuan penolakan dari bank, maka PENJUAL akan mengembalikan uang muka yang telah diterima tanpa bunga, setelah dikurangi denda dan PPh. Sedangkan uang tanda jadi tidak dapat dikembalikan.
12.4 Apabila PEMBELI membatalkan perjanjian ini dengan alasan lain, maka seluruh jumlah uang tidak dapat dikembalikan.
12.5 Sehubungan dengan pembatalan terhadap perjanjian ini, PARA PIHAK sepakat untuk mengesampibgkan ketentuan Pasal 1266 dan Pasal 1267 Kitab Undang-Undang Hukum Perdata.
